Inverse Condemnation settlement results in $2,350,000.00 recovery for Boydoh & Hale clients

Five hydroelectric power plants represented by Boydoh & Hale attorney Scott Hale settled their inverse condemnation lawsuit against the Piedmont Triad Regional Water Authority for $2,350,000.00. Mr. Hale represented the power plants from the trial court all the way to the North Carolina Supreme Court. After fully reviewing the matter and hearing oral argument, the North Carolina Supreme Court refused to reverse the Court of Appeals’ decision. The Court of Appeals issued a unanimous decision holding that the Water Authority’s construction of the Randleman Dam resulted in the taking of the plaintiffs’ riparian rights requiring the Water Authority to compensate the five power plants represented by Boydoh & Hale. The Water Authority agreed to settle with the power plants to avoid a jury trial on the issue of damages.
